1.4 Our website provides access to an online clinical assessment to facilitate the issuance of private prescriptions and the supply of medication to you.

2.1 Our website is operated by Oushk Pharmacy Ltd. ("we"). We are a company registered in Scotland under company number SC740251, with our registered trading address at 58 Long Lane, Broughty Ferry, Dundee, Scotland, DD5 1HH.

2.2 We are regulated by the Medicines and Healthcare Products Regulatory Authority and registered with the General Pharmaceutical Council.

3. Our Services and how you should use them

3.1 We offer medical consultations based on online questionnaires you complete and/or through telephone conversations.

3.2 If, based on our medical assessment, we determine that you are suitable for treatment, we will issue a prescription.

3.3 All our medical questions have been thoughtfully prepared and are in line with best medical practices.

3.4 The website is intended for use by residents of the United Kingdom and Europe. Individuals accessing the website from outside of these jurisdictions are responsible for ensuring compliance with any relevant local laws in that country, to the extent local laws apply.

3.5 Our website is available only to individuals who can enter into legally binding contracts under applicable law. You must be at least 18 years old to purchase our products or use our services. If you do not meet these criteria, you must exit our website immediately. By placing an order request, you confirm that you are at least 18 years of age, or older if required by any applicable law in your jurisdiction.

4. Conditions of supply

4.1 We accept your order when we send you an email confirming the approval of your prescription.

4.2 If we are unable to accept your order, we will inform you and will not charge you for the product. This could be due to factors such as product unavailability, unexpected resource limitations beyond reasonable planning, clinical inappropriateness for the product ordered, errors in the product description or price, or inability to meet a delivery deadline.

4.3 An order number will be assigned to you when we accept your order. Please use this order number as a reference when contacting us.

4.4 We exclusively sell to the UK and EU. Our website is dedicated to the sale and supply of products in the UK and EU, and we do not deliver to addresses outside of the UK.

4.5 We provide treatment and advice only in English, and it is your responsibility to ensure that you fully understand our guidance.

4.6 In emergency situations, please consult your local doctor, pharmacy, or the emergency department at a hospital, as this website is not for emergencies.

4.7 The packaging of products may differ from the images displayed on our website.

5. Medical Information

6. Products

6.1 The images featured on the website are for illustrative purposes only.

6.2 All products displayed on our website are subject to availability. We will notify you by email to confirm acceptance of your order or, in cases where a product is unavailable, we will not process your order request.

6.3 Prices for products or services may change periodically due to variations in the cost of medicines. However, these changes will not affect orders placed before the price adjustment.

6.4 Our website contains a wide range of products, and it is possible that some may be incorrectly priced. As part of our order processing, we verify prices to rectify any errors and make you aware of them. If a pricing error is evident and could reasonably be recognized by you as a mispricing, we are not obligated to provide the product at the lower price.

7. Payments, Cancellations, and Refunds

7.1 Oushk Pharmacy is legally obligated to disclose the costs of treatments and any postage charges to users of its website before consultations take place. There will be no undisclosed fees.

7.2 Customers must ensure that their payment information, including debit or credit card details, are current and valid. Failure to provide valid payment information may result in non-delivery of medications. Oushk Pharmacy will attempt to contact customers for updated payment details if necessary.

7.3 Ordering medicines or engaging in services requiring prescriptions initiates a clinical assessment by our medical and pharmacy team to determine your eligibility for the medication. By placing your order, you consent to this assessment and acknowledge that you forfeit your right to cancel the order under The Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013 once it has been placed.

7.4 Orders may be canceled before the issuance of dispatch confirmation. If canceled, Oushk Pharmacy will send a cancellation confirmation via email and refund any payments made, except as noted in clause 7.7.

7.5 Due to the medicinal nature of our products, orders cannot be canceled or returned once dispatch confirmation is issued. This does not affect statutory consumer rights concerning faulty or inaccurately described products.

7.6 For products that are faulty or not as described, customers should notify Oushk Pharmacy in writing and return the item promptly. Eligibility for refunds in these cases will be determined as outlined in clause 7.9.

7.7 Should an order be canceled before dispatch, an administrative fee of £10 may be charged to cover incurred expenses. This fee also applies if Oushk Pharmacy cancels an order due to a lack of necessary information from the customer. There are no fees for cancellations made by Oushk Pharmacy for other reasons.

7.8 In cases where products are returned due to being faulty or not as described, Oushk Pharmacy will assess the return for a potential refund, notifying the customer via email. Return postage costs are the responsibility of the customer.

7.9 Refunds will be processed using the original payment method, or through an alternative arrangement made with the customer.

7.10 Refunds, where due, will be processed within 28 days following email confirmation to the customer regarding entitlement to a refund for defective products.

8. Delivery

8.1 Medications will only be dispatched following clinical approval by Oushk Pharmacy's team.

8.2 The delivery timeline commences upon prescription authorization.

8.3 Responsibility for the products transfers to the customer upon dispatch to the specified delivery address, or as directed by the customer.

8.4 After order processing, changes to shipping or billing addresses are not permissible due to prescription regulations.

9. Personal Information

9.1 Oushk Pharmacy utilizes personal information in compliance with its Privacy Policy. Customers should review these policies carefully.

9.2 By utilizing the Oushk Pharmacy website, customers consent to the privacy and cookie policy, ensuring all provided data is accurate.

9.3 Identity verification by Experian Ltd may be required. Failure to pass this check will prevent prescription services. Treatment data will not be shared with third parties without consent.

9.4 EU data protection laws restrict the sharing of treatment information with doctors without customer consent, though it is recommended for optimal care.

10. Accessing Our Website

10.1 Website access is granted temporarily, with Oushk Pharmacy reserving the right to modify or withdraw services without notice. Unavailability of the website at any period is not the responsibility of Oushk Pharmacy.

10.2 Users must ensure that all individuals accessing the website through their internet connection are aware of these terms and comply accordingly.

11. Our Liability

15. Prescription Medicines

15.1 The statutory “cooling off” right does not apply to the supply of prescription medicines and the supply of other medicines by a health care professional as part of a health service. When you place an order for medicines or take up a service that involves the prescribing of medicines this will require us to perform an assessment of your clinical suitability for the medicines before they can be approved for supply (“Clinical Assessment”). When you place an order, you agree to us commencing this Clinical Assessment and once this Clinical Assessment has been completed, you will have no legal right to cancel your order.

Examples of this service are: vaccination services and prescription services or medicated weight loss injection treatments including Saxenda®️, Wegovy®️ and Mounjaro®️.

15. Entire Agreement

15.1 These terms, along with referenced documents, constitute the full agreement between Oushk Pharmacy and its users regarding the website use.
